2022 Holiday Sessions
A specialized holiday set is created and set up in the studio for this special event.
These session are best for families with up to 3 children so everyone can fit in the set properly. We also welcome couples or you can have the session just for your children. Adults will be seated and often will have children on laps so plan your outfits accordingly. Older children may be posed standing if they are under 5ft.
Each time slot allows for 20 min for portraits which is plenty time to get lots of fabulous portraits. My final galleries normally have 10-20 images for you to choose from.
A. Session Fees
Client agrees to pay photographer the following;
1 Non-refundable Retainer of $300 at the time of booking to secure the appointment date and time.
Studio Family Holiday Session - $300 - 6 digital images are included with print release for personal use. You will be able to choose your portraits from a gallery of approximately 10-20 images. Prints and additional digital files will be available for purchase should you choose to do so.
Sessions will take place on November 15th - 19th at the Tori Gansen Photography portrait studio. The studio is located in a separate building behind my home at 6900 Cherokee Ave Ft Myers Fl 33905. Please arrive 10 minutes before your time to allow for any clothing changes or feeding.
B. Time line
Client agrees to the following delivery timeline: Complete editing time takes up to 3 weeks but may be completed sooner. I aim to your your portraits complete as quickly as possible. You will be notified by e-mail as soon as your photos are ready. Photos will be uploaded to your gallery and you will receive an e-mail notification when ready. Galleries will expire after 30 days. Final selections will be delivered via digital download.
C. Location
Shoot location will be at the Tori Gansen Photography Studio located at 6900 Cherokee Ave. Fort Myers Fl. Studio is located in a separate building on my personal property. If an issue with the location arises and the location must be moved you will be notified as quickly as possible.
D. Rescheduling
Due to the limited nature of this session rescheduling will not be available. Your session time slot is for 20 min. If the client is more than 5 min late all fees will be forfeited and the session cancelled. Sessions are scheduled back to back so I will not be able to accommodate late clients as I must stay on schedule.
E. Re-shoots / Refunds
Due to the specialized nature of these sessions re-shoots and/or refunds will not be available. Re-shoots will not be given for poor choices of clothing, make-up, hair, weather related issues, poor behavior, lack of cooperation by children or by not following the recommendations of the photographer. No refunds will be given. If the session is cancelled with at least 72 hours notice your fee may applied towards a future session. The buyer understands that by securing this time slot the Photographer is foregoing other photographic jobs for that time slot and for that reason the retainer fee is non-refundable.
F. Archive
After 30 days, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
G. Model Release
I hereby give to Tori Gansen Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:
a) To copyright the same in the photographer’s name or any other name that he/she may select;
b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy. Revocation of this release is not valid unless sent in writing prior to the session taking place.
H. Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. Client and members of Client’s party assume all risks associated with potential COVID-19 transmission or exposure in relation to the photography services being provided and accept sole responsibility for an illness, injury, damages, claims or expense arising therefrom. Based upon the scope of the social distancing restrictions in place at the time of the photography services, certain aspects of the photographer/client interaction may be altered by necessity. Client and members of Client’s party explicitly agree and understand that failure to adhere to social distancing measures places them at increased risk of COVID-19 exposure or transmission. Notwithstanding the foregoing, the Waivers contained in this agreement shall not be interpreted to prohibit actions or claims against persons who knowingly participate in the photography services while exhibiting COVID-19 symptoms or who knowingly participate while having an active COVID-19 infection. No persons who are ill, showings signs of illness or have been ill within 10 days will be permitted into the studio. This is for safety and well being of all of my clients.
I. Copyright & Penalty
Tori Gansen Photography retains all copyrights to all images created during client’s session. A limited print release will be with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Tori Gansen Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file. No images may be shared on line or in any similar medium without my watermark clearly visible.
J. Session Requests
*No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer, including a written agreement.
*Session starts at the agreed upon time. It is strongly encouraged that client arrives 10 minutes prior to the start of session. This allows for any last-minute feeding, changing, and relaxing before session begins.
*Please do not bring any children or persons not being photographed to the session as this can be a distraction for young children.
*Please make sure hair is combed and face is clean and free of runny noses or eyes.
*Please avoid eating or drinking red or orange food or drinks before session, as red and orange tend to leave a stain on the face.
K. Editing
Portraits will be edited in my standard style and according to my artistic vision. Special editing requests outside of my control will be charged for at my standard rate; ie. skin discolorations, tan lines, runny noses, hair or clothing out of place.
